Bradley Shear, according to NBC News, is the "public face" of a campaign to prevent businesses and institutions from requiring employees or students to disclose their personal Facebook usernames and passwords in order to qualify for a job or a scholarship. Bradley is a lawyer, social media specialist, and consultant who advises individuals, businesses, governments, and others on digital technology challenges. The media frequently requests Bradley's analysis. The New York Times, The Wall Street Journal, The Washington Post, The Associated Press, The BBC, and other news organizations have also used his analysis. The State of Maryland enlisted Bradley's help in drafting the country's first social media political advertising legislation in 2010. Bradley collaborated with state authorities to ensure that its objectives were met while minimizing the impact on the internet advertising business. His efforts were so effective that he received public support for the restrictions he crafted from Facebook, AOL, and Google. Bradley initiated the push to end the practice of requiring employees and students throughout the country to disclose their personal Facebook usernames and passwords and/or download social media monitoring software in order to qualify for a job or maintain their college scholarship. Bradley has campaigned with state and federal officials on behalf of clients to create legislation that protects personal social media privacy while also protecting companies and schools from spurious social media litigation. As a result of his work, Maryland, Illinois, Delaware, and California have all passed legislation prohibiting these activities, and at least 15 states have introduced social media privacy legislation. Bradley has become a valued consultant to state and federal politicians around the country on social media policy as a result of his efforts. Bradley persuaded U.S. Rep. Eliot Engel of New York after a chance encounter that national social media privacy laws would benefit the entire country. Following that, he collaborated with Rep. Engel's office on HR 5050, the Social Networking Online Protection Act (SNOPA). This bill would safeguard employees' and students' personal digital privacy rights while simultaneously insulating corporations and institutions from some social media legal liabilities. This breakthrough legislation is the world's first national legislation of its sort. Bradley's professional digital experience began in the late 1990s, during the height of the first tech boom. He worked at the National Football League Players Association during this period, when he first learned about the legal and marketing challenges that professional players face on the Internet. Bradley went on to work for J.P. Morgan Chase and a digital entertainment start-up after that. He is a member of Harvard Law School's Berkman Center For Internet and Society's Online Media Legal Network, the University of Baltimore's Center for Sport and the Law's Board of Advisors, and an adjunct lecturer in The George Washington University's MBA program. Bradley's blog, "Shear on Social Media Law," is the first publication to focus on social media law and public policy, and is syndicated by the publisher of the National Law Journal and The American Lawyer. Bradley practices law in the Washington, DC region, where he counsels clients on social media law and policy, as well as digital advertising, business, proprietary information, privacy, entertainment, and athletics.
